Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and DigiMe App ("Company," "we," "us," or "our") governing your access to and use of our website, mobile applications, and all related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Services.


Description of Services

DigiMe App provides AI-powered business growth tools, including but not limited to:

  • AI Receptionist and virtual phone answering systems
  • Missed call SMS text-back automation
  • Smart website chatbot for appointment booking
  • Multi-channel unified inbox (SMS, email, social media)
  • Automated appointment management and reminders
  • Review generation and reputation management
  • Customer Relationship Management (CRM) tools
  • Analytics and reporting dashboards

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.


Account Registration

To access certain features of the Services, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information to keep it accurate and current
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access to or use of your account

You must be at least 18 years old to create an account and use the Services. By creating an account, you represent and warrant that you are at least 18 years of age.


Subscription & Payment Terms

Billing

Access to the Services requires a paid subscription. By subscribing, you authorize DigiMe App to charge your designated payment method on a recurring basis (monthly or annually, depending on your selected plan) until you cancel your subscription.

Pricing

All prices are listed in U.S. Dollars (USD) unless otherwise stated. We reserve the right to change our pricing at any time. If we change pricing for your current plan, we will provide at least 30 days' advance notice before the new pricing takes effect.

Payment Processing

All payment transactions are processed through our third-party payment processor, Stripe (stripe.com). DigiMe App does not store credit card numbers or banking information on its servers. By providing payment information, you agree to Stripe's Terms of Service and Privacy Policy.

Refunds

All subscriptions include a 30-day money-back guarantee from the date of initial purchase. After the 30-day period, fees are non-refundable except where required by applicable law. No refunds will be issued for partial months of service.


Cancellation Policy

You may cancel your subscription at any time by contacting our support team at [email protected]. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will not be charged for subsequent billing periods
  • No partial refunds will be issued for the remaining days in your current billing period
  • Your data will be retained for 30 days after cancellation, after which it will be permanently deleted

There are no cancellation fees, early termination penalties, or long-term contracts.


Acceptable Use Policy

You agree not to use the Services to:

  • Violate any applicable federal, state, local, or international law or regulation
  • Send unsolicited communications (spam), including but not limited to bulk SMS, email, or other messages
  • Transmit any material that is defamatory, obscene, threatening, abusive, or otherwise objectionable
  • Impersonate or attempt to impersonate any person, business, or entity
  • Infringe upon or violate the intellectual property rights or privacy rights of any third party
  • Introduce viruses, malware, or other harmful code into the Services
  • Attempt to gain unauthorized access to any portion of the Services or any related systems or networks
  • Use the Services in any manner that could disable, overburden, damage, or impair the Services
  • Engage in data mining, scraping, or any automated data collection from the Services
  • Use the AI features to generate content that violates applicable laws or professional ethics rules

Intellectual Property

The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and code) are owned by DigiMe App and are protected by U.S. and international copyright, trademark, patent, and other intellectual property laws.

You retain ownership of all data and content that you upload, submit, or transmit through the Services ("Your Content"). By using the Services, you grant DigiMe App a limited, non-exclusive, royalty-free license to use, store, and process Your Content solely for the purpose of providing and improving the Services.


Data & Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

You are responsible for ensuring that your use of the Services complies with all applicable data protection and privacy laws, including but not limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), the Telephone Consumer Protection Act (TCPA), and the CAN-SPAM Act.


Compliance with Industry Regulations

If you are a professional operating in a regulated industry (including but not limited to healthcare, legal, financial, or real estate), you are solely responsible for ensuring your use of the Services complies with all applicable professional regulations, ethical standards, and licensing requirements.

DigiMe App provides tools for business communication and automation. We do not provide legal advice, medical advice, financial advice, or any other form of professional advice. The AI-powered features of our Services are designed to handle scheduling, general inquiries, and administrative tasks — not to replace professional judgment.


Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIGIME APP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any interruption or cessation of transmission to or from the Services
  • Any bugs, viruses, or other harmful code that may be transmitted through the Services

In no event shall DigiMe App's total aggregate liability to you for all claims relating to the Services exceed the total amount paid by you to DigiMe App during the twelve (12) month period immediately preceding the event giving rise to the claim.


Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. DIGIME APP EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DigiMe App does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not guarantee any specific results from the use of the Services, including but not limited to any particular number of leads, appointments, or revenue.


Indemnification

You agree to indemnify, defend, and hold harmless DigiMe App, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you submit, post, or transmit through the Services

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in Dallas County, Texas.


Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue using the Services.


Miscellaneous

Entire Agreement

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and DigiMe App concerning the Services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Waiver

The failure of DigiMe App to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. DigiMe App may assign these Terms without restriction.
